1. Acceptance of terms

By accessing the Site or signing a statement of work with us, you confirm that you have read, understood and agreed to these Terms. If you do not agree, please discontinue your use of the Site.

2. Services

We provide consulting, strategy, creative production, media planning and buying, performance marketing and related growth services. Any specific engagement, including scope, deliverables, timelines and fees, is governed by a separate signed proposal or statement of work between you and us.

3. Use of the website

You agree to use the Site only for lawful purposes and in a way that does not infringe on the rights of others. You will not attempt to interfere with the Site's operation, reverse engineer our code, scrape large volumes of content, or use the Site to transmit harmful material.

4. Intellectual property

All content on the Site — copy, graphics, logos, layouts, SVG illustrations and code — is owned by or licensed to ASKSHASHANK.COM and is protected under applicable intellectual-property laws.

Work produced for clients under a signed engagement is governed by the IP terms in the corresponding statement of work. Generally, finished deliverables transfer to the client on full payment; working files, frameworks and underlying methodologies remain with us.

5. Payment terms

Engagement-specific payment terms are agreed in the statement of work. Invoices are typically due within 14 days. Late payments may incur a reasonable interest charge and may pause active work — we'd much rather get on the phone than do that, so flag any issue early.

6. Confidentiality

We treat all client information shared during an engagement as confidential. We're happy to sign mutual NDAs, and the same expectation applies to materials we share with you — strategies, frameworks, templates and creative concepts.

7. Disclaimers

Advertising and marketing outcomes are influenced by many factors outside our control — product, pricing, market timing, platform changes. We commit to disciplined execution and transparent reporting, but we cannot and do not guarantee specific results unless expressly stated in a statement of work.

The Site is provided "as is" without warranty of any kind. We make no representation that the Site will be uninterrupted, error-free, or free of harmful components.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the Site or our services shall not exceed the fees paid by you to us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages.

9. Third-party links and platforms

The Site may contain links to third-party websites or services, and our work necessarily involves third-party ad platforms. We are not responsible for the policies, practices or pricing changes of any third party.

10. Termination

Either party may terminate an engagement in accordance with the notice period set out in the statement of work. We may suspend or terminate access to the Site at any time for conduct that we determine, in our reasonable judgment, to violate these Terms.

11. Governing law

These Terms shall be governed by and construed in accordance with applicable international commercial law. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. Failing that, the dispute shall be finally resolved by binding arbitration in a neutral jurisdiction mutually agreed upon by the parties, conducted in English.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be notified by updating the "Last updated" date above. Continued use of the Site after a change indicates your acceptance of the revised Terms.
